Press Option and Empty Trash. The Option key is an override.
If Option doesn't work, restart and try Empty.
I did try to shut down and then trash but it did not work, i did down load trash it app and tried but failed.

Files that are in use by an application cannot be deleted -- such as a PDF file open in Preview.
Simplest way to treat this is to re-boot the computer, then empty the trash.
