The courts, Tony, can do just about anything judges want.  They define what laws mean, and that's an enormous power.

So yes, sure they could do that.  It's very unlikely they would do that, though, because current political thinking doesn't flow in that channel.  Yet.

They asked, and Apple offered them a variety of help. The main thing they needed could not be done because they had stupidly made it impossible by allowing the iCloud password to be changed.

Then they got a court to issue an order for an action that was beyond the scope of the court's legal authority.
