Apple does give up data with a court order if the data is available. Even Apple at the hearing admitted that directly and proudly. They have staff devoted to complying with court orders 24 x 7 x 365 and on older iOS versions (pre v8) they routinely give out data when compelled by court.
And they do not dispute that in public safety situations they will give up data they can access. Their security strategy is getting mature enough they cannot access the data to give it by design.
