I’m on AT&T. Before they offered tethering I jailbroke my iPhone and tethered it against their rules. Now that I have a 4S with legal tethering I pay the extra $15/mo. and tether with their blessing.

Read your TOS. In most cases, tethering is not allowed. It is not like you are going to jail if you are caught. You do, however, run the risk of termination and/or big fees.
