I agree, it certainly does. However, the message it conveys is that the speaker/repeater doesn't know the difference between the Constitution and the Declaration of Independence.

possibly…I wasn't there. but regardless of who or who did not say it or even said it first does not diminish in any way the message it conveys.

I rather doubt Mr. Franklin ever said this, since the right to pursue happiness is mentioned nowhere in the U.S. Constitution, and I feel confident that he knew this.
