You always have 30 days to return the product no matter what.
So, if you bought it within the last month and want to upgrade, better do the return quick and wait for the new one.

It used to be that Apple would replace the immediately preceeding product if it had been bought within a limited time frame. Might be a good idea to take your New iPad and store receipt to your Apple Store. Or call their regular number which I forget at this moment.
