And by scofflaw Apple, which allowed these apps to be posted to iTunes
in the first place. It's not as if the app as Apple vetted it was one
thing, but then Amazon sneaked some secret code in that magically
changed the app on my iPad to do something that Apple couldn't see when
it received and approved the app for posting at iTunes.

It's the timing of the thing -- if these apps violate the contract, they
violated the contract when Apple first approved them, so if there's any
"fault" here it's that Apple didn't know the terms of its own contract
when it approved the apps in the first place.
